Overview

At Mellyngtton, we want you to feel confident when shopping with us.

This Return & Refund Policy explains your rights when returning products purchased through Mellyngtton.store and is designed to operate in accordance with the Australian Consumer Law (ACL).

Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Australian Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Products sold by Mellyngtton must, where applicable, be of acceptable quality, be fit for their intended purpose, match their description, correspond with any sample or representation provided, and satisfy any other consumer guarantees required by law.

If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and whether the failure is major or minor.

Your rights under the Australian Consumer Law apply in addition to any voluntary returns policy offered by Mellyngtton.

Major Problems With a Product

A product may have a major failure where, for example:

  • a reasonable consumer would not have purchased the product had they known about the problem;

  • the product is substantially different from its description, sample or representation;

  • the product is substantially unfit for its normal purpose and cannot easily be fixed within a reasonable time;

  • the product is unfit for a particular purpose that you made known to us and cannot easily be fixed within a reasonable time; or

  • the product is unsafe.

Where a product has a major failure under the Australian Consumer Law, you may be entitled to choose between a refund and a replacement.

You may also choose to keep the product and seek compensation for any reduction in its value where permitted by law.

You may also be entitled to compensation for other reasonably foreseeable loss or damage resulting from a failure to comply with a consumer guarantee.

Minor Problems With a Product

If a product has a problem that is not considered a major failure, Mellyngtton is entitled to provide an appropriate remedy within a reasonable period.

Depending on the circumstances, this may include repairing or replacing the product.

If we cannot or do not remedy the problem within a reasonable time, you may be entitled to further remedies available under the Australian Consumer Law, which may include obtaining a refund or replacement or having the problem remedied elsewhere and recovering reasonable costs where legally applicable.

Faulty, Damaged or Incorrect Products

If you receive an item that is faulty, damaged, defective, materially different from its description or not the item you ordered, please contact us at:

Please provide your order number, a description of the issue and, where reasonably available, photographs or other information that may help us assess the product.

We may reasonably inspect or assess the product before confirming the appropriate remedy.

Providing photographs may assist us in processing your claim, but a customer's statutory rights will not be refused solely because photographs cannot reasonably be provided.

Proof of Purchase

We may request reasonable proof of purchase before processing a return, refund, repair or replacement.

Acceptable proof may include an order confirmation, receipt, transaction record, payment statement or other documentation that reasonably demonstrates that the product was purchased from Mellyngtton.

For claims made under the Australian Consumer Law, original packaging is not required merely for the customer to exercise their statutory rights.

30-Day Change of Mind Returns

In addition to your statutory rights, Mellyngtton offers a voluntary 30-day change of mind return period.

You may request a change of mind return within 30 days of receiving your order.

To qualify for a change of mind return, the product must be unused, unworn, unwashed and in substantially the same condition in which it was received. Where applicable, original tags, labels, accessories and packaging should remain attached or included.

This 30-day period applies only to voluntary change of mind returns. It does not limit any rights you may have under the Australian Consumer Law in relation to faulty or non-compliant goods.

Change of Mind Exclusions

Subject always to the Australian Consumer Law, we may refuse a voluntary change of mind return where the product:

has been worn, washed, altered, damaged after delivery or used beyond what is reasonably necessary to inspect it; is missing essential parts or accessories; is a personalised or customised product; or is a hygiene-sensitive product that cannot reasonably be resold once opened or used.

Any exclusion relating to change of mind returns does not apply where the customer is entitled to a remedy under the Australian Consumer Law.

Sale, discounted or promotional products remain covered by all applicable consumer guarantees under the Australian Consumer Law.

How to Request a Return

Before sending any product back to us, please contact:

Include your order number and the reason for your return.

We will provide you with the appropriate return instructions and, where applicable, the return destination.

Products should not be sent to an address that has not been confirmed by our customer support team.

Return Shipping Costs

For voluntary change of mind returns, the customer is responsible for the cost of returning the product unless we agree otherwise.

Where a product is confirmed to have a problem covered by the Australian Consumer Law, Mellyngtton will reimburse reasonable return postage or transportation costs where required by law.

Where a faulty product is large, heavy or otherwise difficult to return, we will arrange collection or otherwise meet our obligations regarding return costs where required under the Australian Consumer Law.

Customers should retain receipts or other evidence of reasonable return postage costs when seeking reimbursement.

Refunds

Once a refund has been approved, we will process it using the original payment method unless you agree to another method.

For a major failure covered by the Australian Consumer Law, an applicable refund will be for the amount paid for the affected product as required by law.

We will not impose a restocking fee or other deduction that unlawfully reduces a refund to which a customer is entitled under the Australian Consumer Law.

The time taken for the refunded amount to appear in your account after we process it may depend on your bank, card issuer or payment provider.

Exchanges and Replacements

Where an exchange or replacement is available, we will provide instructions after assessing your request.

If a replacement product cannot reasonably be supplied, we will provide another remedy where required by the Australian Consumer Law.

Availability of voluntary exchanges for change of mind returns may depend on stock availability.

Incorrect Size or Fit

Selecting an incorrect size or deciding that an item does not fit as preferred will generally be treated as a change of mind return unless the product itself does not match the size, measurements, description or other representations provided by Mellyngtton.

Eligible change of mind returns remain subject to the conditions set out in this policy.

Nothing in this section affects your rights where a product does not comply with the Australian Consumer Law.

Order Cancellations

If you wish to cancel an order, please contact us as soon as possible at costumer@Mellyngtton.store.

We will attempt to accommodate cancellation requests where possible.

If the order has already been processed or dispatched, cancellation may no longer be possible and the applicable return procedures may need to be followed after delivery.

This does not affect any rights or remedies available under applicable law.

Lost or Missing Returns

For change of mind returns arranged by the customer, we recommend using a tracked delivery service and retaining proof of postage until your return has been completed.

Mellyngtton is not responsible for a change of mind return that is lost before being received by us where the return shipping was independently arranged by the customer, except where applicable law provides otherwise.

Refused Deliveries and Incorrect Addresses

Customers are responsible for providing complete and accurate delivery information when placing an order.

Where an order is returned because an incorrect or incomplete address was provided, or because delivery was refused without a legally valid reason, reasonable delivery or return costs may be deducted from any voluntary refund where permitted by law.

Nothing in this section limits any remedy available under the Australian Consumer Law.

Items Purchased During Promotions or Sales

Products purchased during a sale, promotion or with a discount remain protected by the Australian Consumer Law.

We do not exclude refunds, replacements or other statutory remedies merely because a product was discounted or sold as part of a promotion.

However, we may apply different conditions to voluntary change of mind returns for clearly identified promotional or clearance products, provided those conditions do not restrict statutory consumer rights.

Consumer Guarantees Take Priority

Our voluntary return conditions, including the 30-day return period and requirements relating to condition, tags or packaging, apply only where legally permitted.

They do not override the Australian Consumer Law.

Where there is any inconsistency between this policy and a mandatory right or remedy under Australian law, the mandatory legal requirement will apply.
